Annulment vs. Divorce in New Jersey

The difference between annulment and divorce is fundamental. A divorce ends a marriage that was legally valid. An annulment is a court’s declaration that the marriage was never valid in the first place. When a judgment of nullity is issued, the law treats the marriage as though it never occurred.

That distinction has real consequences. Because annulment applies only when defined statutory grounds exist under N.J.S.A. 2A:34-1, not everyone who prefers an annulment will qualify for one. New Jersey doesn’t require a minimum residency period to file for annulment, unlike divorce, which requires at least 12 consecutive months of residency under N.J.S.A. 2A:34-10. The evidentiary burden is higher, too: clear and convincing evidence, compared to the preponderance standard used in most civil matters. And a party who continues living as a married couple after discovering grounds for annulment may be found to have ratified the marriage, which can defeat the claim.

Statutory Grounds for Annulment Under N.J.S.A. 2A:34-1

New Jersey courts won’t grant an annulment because a marriage was brief or because a party would prefer it to divorce. A recognized statutory ground must exist. The statute identifies several bases, though courts retain some equitable authority in how they apply the law to specific facts:

Bigamy: Either party was already married, in a civil union, or in a domestic partnership at the time of the marriage.
Incest: The parties are related within the degrees of kinship prohibited by law.
Underage marriage: Either party was under 18 at the time of the marriage and hasn’t ratified the marriage since turning 18.
Mental incapacity, intoxication, or lack of assent: Either party lacked the capacity to understand the nature of marriage due to mental condition, intoxication, or similar agents, or the marriage occurred under duress or fraud as to its essentials, provided the marriage hasn’t been ratified.
Physical and incurable impotence: Either party was physically and incurably impotent at the time of the marriage, the other party was unaware of this, and the marriage hasn’t been subsequently ratified.

Fraud as to the essentials of marriage is one of the more commonly invoked grounds, but courts define it narrowly. The deception must go to a fundamental element of the marriage relationship itself, not merely a material fact about a spouse’s background or circumstances.

Property, Alimony, & Children in a New Jersey Annulment

Because an annulment treats the marriage as though it never existed, equitable distribution, the framework that governs marital property division in a New Jersey divorce, does not apply. Instead, property generally reverts to the titled owner. Jointly titled property is divided equally rather than through the equitable distribution analysis a court would apply in divorce proceedings. Parties with significant jointly held or commingled assets should understand this difference before deciding how to proceed.

Alimony doesn’t disappear entirely. Under N.J.S.A. 2A:34-23, New Jersey courts retain the authority to award alimony in annulment proceedings, applying the same need-and-ability-to-pay analysis used in divorce. If children are involved, the court retains full jurisdiction over custody and child support, applying the best-interests-of-the-child standard used in any other family matter. Children born of a marriage that is later annulled retain their legal status, and both parents’ obligations to them remain fully intact.

The Annulment Process in Morris County Superior Court

A New Jersey annulment begins with filing a Complaint for Annulment with the Superior Court, Family Division, in the county where either party resides. For clients in the Morristown area, that filing is made with the Morris County Superior Court Family Division. The complaint must identify the parties, the marriage, any children, and the specific ground under N.J.S.A. 2A:34-1 being claimed, supported by a certification of facts.

After filing, the other spouse must be served and has 35 days to file an Answer. If the annulment is uncontested, the matter can often proceed without a formal hearing. A contested annulment, where the other spouse disputes the grounds or raises a defense such as ratification, may involve case management, discovery, mediation, and ultimately trial.

There’s no statutory deadline to file, but delays can weaken a case if continued cohabitation is later raised as ratification. Early preparation and thorough evidence development can affect how a court evaluates the claim.

Legal Annulment vs. Religious Annulment in New Jersey

These are two separate proceedings governed by entirely different institutions, and they don’t automatically follow from one another. A legal annulment is a judgment issued by a New Jersey state court that voids the marriage under civil law. A religious annulment is a determination made by a religious institution according to its own internal rules and doctrine. One has no automatic effect on the other.

A civil annulment doesn’t produce a religious annulment, and a religious annulment doesn’t change a person’s legal marital status in New Jersey. People who seek a legal annulment for religious reasons must still satisfy one of the statutory grounds under N.J.S.A. 2A:34-1. A court won’t grant a judgment of nullity on religious motivation alone, regardless of how significant that motivation may be to the individual. In some cases, a civil annulment can support a subsequent application for a religious annulment depending on the institution’s rules, but that relationship runs in one direction only.

Ratification & Timing Considerations

Ratification is a legal defense that can defeat an otherwise valid annulment claim. If a party discovers grounds for annulment but continues to live as a married couple, a court may conclude the marriage was ratified and deny the petition. For underage marriage specifically, ratification occurs when a party continues the marriage after turning 18 without taking steps to void it.
